Terms of Service

1. Acceptance of Terms

By accessing or using Codunk (codunk.com, studio.codunk.com, and all related subdomains), you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Description of Service

Codunk is a SaaS platform that allows users to create web applications through natural language prompts (vibe coding). The platform provides AI-powered code generation, design, motion design, 3D scene generation, video generation, and image generation. Users can publish their projects on codunk.com subdomains or custom domains.

3. Account Registration

You must create an account to use Codunk. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must provide accurate information and be at least 16 years old.

4. Credits and Billing

• Codunk operates on a credit-based system. Each plan includes a monthly credit allocation.
• Starter plan: $25/month — 270 credits
• Pro plan: $49/month — 600 credits
• Credit Pack: $5 — 70 credits (non-expiring)
• Credit costs vary by operation: standard message (1 credit), image generation (3 credits), 3D generation (20 credits), video generation (30 credits).
• Unused monthly credits roll over for one billing cycle only.
• Payments are processed by Paddle, which acts as Merchant of Record. All billing inquiries should first be directed to Paddle.
• Prices are in USD and exclude applicable taxes, which Paddle handles.

5. Subscriptions and Cancellation

Subscriptions renew automatically. You may cancel at any time through your account settings. Upon cancellation, you retain access until the end of your current billing period. No refunds are provided for partial months. Paddle handles all refund requests in accordance with their policies and applicable consumer protection laws.

6. Intellectual Property — Your Content

• You retain ownership of the original prompts and content you provide to Codunk.
• Code and assets generated by AI through the platform are licensed to you for use within the Codunk ecosystem.
• No export: Generated code and projects cannot be downloaded or exported outside the platform. Your projects are hosted, served, and maintained on Codunk infrastructure.
• You grant Codunk a non-exclusive license to host, store, display, and serve your projects as necessary to operate the service.
• Published sites on *.codunk.site or custom domains remain accessible as long as your account is active and in good standing.

7. Intellectual Property — Codunk

The Codunk platform, brand, UI, documentation, skills system, and underlying technology are the property of Codunk. You may not copy, modify, distribute, or reverse-engineer any part of our platform.

8. AI-Generated Content

• Content generated by AI (code, images, videos, 3D models) is provided as-is.
• We do not guarantee that AI-generated content is free of errors, bugs, or intellectual property conflicts.
• You are responsible for reviewing and testing all generated code before publishing.
• AI-generated images and videos may be subject to the terms of the underlying model providers (Anthropic, OpenAI, Google, Replicate, Runway, Meshy).

9. Acceptable Use

You agree not to use Codunk to:

• Create or distribute malware, phishing pages, or fraudulent content
• Generate illegal, harmful, defamatory, or discriminatory content
• Violate any applicable laws or third-party rights
• Attempt to reverse-engineer, scrape, or extract the platform's code or AI models
• Abuse the credit system or circumvent usage limits
• Resell or redistribute Codunk services without authorization

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.

10. Published Sites

• Sites published on *.codunk.site are hosted via Vercel on our infrastructure.
• You may connect a custom domain. Domain purchases through Codunk are facilitated by third-party registrars (Dynadot/Namecheap) and subject to their terms.
• We reserve the right to take down published sites that violate these terms or applicable laws.
• Published sites may display a minimal Codunk attribution unless you are on a Pro plan.

11. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience downtime. We are not liable for any losses resulting from service interruptions. AI model availability depends on third-party providers.

12. Limitation of Liability

To the maximum extent permitted by law, Codunk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Codunk from any claims, damages, or expenses arising from your use of the service, your published content, or your violation of these terms.

14. Changes to Terms

We may modify these terms at any time. We will notify users of material changes via email or platform notification at least 30 days before they take effect. Continued use after changes constitutes acceptance.

15. Governing Law

These terms are governed by applicable law based on your jurisdiction. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
